1. Who you are contracting with

These Terms & Conditions ("Terms") govern your use of the CASEWRX PRO millwork estimating service (the "Service"), provided by CASEWRX PRO — operated by CASEWRX LABS (the "Seller", "we", "us"), serving the Greater Toronto Area, Ontario, Canada. By creating an account, uploading documents, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms; otherwise you confirm that you are of legal age to enter into this agreement.

2. The Service

CASEWRX PRO is a subscription software service that lets architectural millwork shops upload drawing documents, isolate millwork scope using artificial intelligence, and produce manufacturing and installation cost estimates. The Service includes tools for takeoffs, rate-card based pricing, and client quotation exports.

3. Accounts and credentials

You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

4. Acceptable use

You must not misuse the Service. In particular, you must not:

  • use the Service for any unlawful purpose or in violation of any applicable law;
  • engage in fraud, spam, or harassment through the Service or our contact forms;
  • infringe the intellectual property or other rights of any party, including by uploading documents you do not have the right to use;
  • interfere with the security of the Service, including by introducing malware, probing or scanning for vulnerabilities, circumventing access controls, or scraping the Service other than through its provided interfaces.

5. AI-generated estimates and your responsibilities

The Service uses artificial intelligence to read drawing documents and produce takeoffs and estimates. You acknowledge that:

  • Prohibited use: you may not use the Service to generate illegal content, deepfakes, hate speech, malware, or to attempt to jailbreak, circumvent, or misuse the underlying AI models.
  • Your responsibility: you are responsible for the prompts and documents you submit, for how you use the outputs, for verifying the accuracy of all estimates before relying on them, and for having the rights to the content you input.
  • Accuracy: AI output may be incomplete or inaccurate. Estimates are decision support only and are not suitable for use as professional advice without review by a qualified person. Always confirm scope against the issued drawings before quoting.
  • Content moderation: we may remove or restrict content, refuse or filter outputs, and suspend accounts where required to comply with law or to protect the Service and other users.

6. Intellectual property

The Service, including its software, documentation, branding, rate-card data and content, is owned by CASEWRX PRO — operated by CASEWRX LABS — and protected by laws. You retain ownership of the documents and data you upload. You grant us a limited licence to host, process, and display your uploaded content solely to provide the Service to you. If you believe content accessible through the Service infringes your rights, contact us using the details in Section 14; we will investigate and remove material we determine to be infringing, and repeated infringement may result in account termination.

7. Licence and restrictions

We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan for your own business purposes. You may not reverse engineer the Service, resell or redistribute access to it, or circumvent its technical limits, including per-account quote limits.

8. Payment and subscription terms

Subscriptions are billed on the plan and schedule you select at checkout. Free trial allowances (quotes and trial duration) apply as described in the Service and may change. You may cancel your subscription at any time; access continues to the end of the paid period.

9. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

10. Service level

We do not guarantee that the Service will be uninterrupted or error-free. We may modify or discontinue features from time to time, including during maintenance.

11. Suspension and termination

We may suspend or terminate your access to the Service, with notice where practical, if you materially breach these Terms, fail to pay amounts due, create a security or fraud risk, or repeatedly or seriously violate our policies. When access ends, we will make your uploaded data available for export for 30 days on request, after which it may be deleted.

12. Warranties and liability

The Service is provided "as is". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability to you is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill, except where such exclusion is not permitted by law (including liability for fraud, death, or personal injury where required). You indemnify us against claims arising from your uploaded content, your unlawful use of the Service, or your violation of these Terms.

13. General

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. We may update these Terms from time to time and will post the current version on this page. Continued use of the Service after changes take effect constitutes acceptance. If any provision is unenforceable, the remainder continues in effect. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control.
